Is Trading XAU/USD on a Swap-Free Account Allowed?

Private: Is Trading XAU/USD on a Swap-Free Account Allowed?

Question

As-Salaamu Alaykum respected Mufti and Fatwa Committee

Is trading XAU/USD (gold against the US dollar) through XM’s swap-free Islamic account permissible under Shariah, considering that I use interest-free 1:1000 leverage, do not incur overnight interest or financing charges, and risk only the funds deposited? If it is impermissible, what specific aspect of the trading arrangement makes it so, particularly regarding leverage, ownership, or the contract structure?

Answer

With regards to your query please be advised:

  1. The trading described in your query is defined as a gold contract for difference (CFD). “A Contract for Difference (CFD) represents a sophisticated financial derivative used by traders to speculate on short-term price movements of various underlying instruments. Settlements are executed in cash as there is no exchange of physical goods or securities.” [Investopedia]
  2. The key features of these contracts are that they represent a speculation on short-term price movements — in the case at hand, the movement of the price of gold against the US dollar — and that there is at no stage any ownership of the underlying asset.
  3. Trading in gold and in currency exchange is governed by strict conditions designed to prevent interest by delay (ribā al-nasīʾah). Such trading would thus require that there be immediate receipt and exchange of the currency and the commodity before the parties separate. As al-Nawawī states in Rawḍat al-Ṭālibīn: “If the genus differs, such as wheat for barley, or gold for silver, parity in weight is not required, but spot exchange (al-hulūl) and mutual possession in the session (al-taqābuḍ fī al-majlis) are strictly required.”
  4. In the CFD contract, there is no physical or constructive possession, and neither the trader nor the broker takes delivery of allocated gold or acquires legal title to real gold during the trading session.
  5. The provision of leverage by the broker, notwithstanding that it is extended free of interest, nonetheless constitutes a loan accompanied by a compensatory trade, and does not remedy the underlying structural defect in the contract, namely the absence of spot possession in an exchange of ribawī assets.
